The Punters Coalition (TPC) Terms of Service

If you do not agree to these Terms, you must not access or use TPC or pay subscription fees.

“Platform” / “Software”: TPC’s websites, web apps, dashboards, calculators, desktop/mobile applications, APIs, automations, and related tools.

“Services”: Access to the Platform, features (including automation), content, knowledge base, support, communities, and related materials.

“Third-Party Betting Programs/Operators”: Any third-party wagering, bookmaker, betting exchange, or similar provider you authorise to interact with via the Platform.

“You” / “User”: The individual or entity accessing or using the Platform/Services.

• You must be 18+ (or the legal gambling age in your jurisdiction) and legally permitted to use wagering-related software.

• Information supplied to TPC must be accurate and current. You are responsible for safeguarding credentials and all activity under your account.

• You must comply with all Third-Party Betting Programs/Operators’ terms, rules, limits, and policies.

• You may not use the Platform where prohibited by law, sanction, or applicable operator policies.

• TPC provides software tools, systems, and automations designed to assist you in configuring and triggering bonus bets and other wagering-related actions with Third-Party Betting Programs/Operators, based on your inputs and rules.

• TPC is not a bookmaker or exchange and does not accept or hold customer funds for betting.

• You authorise all linked accounts and control your settings. All bets, transactions, and outcomes occur on third-party platforms.

• Bonus offers/promotions, operator limits, and access to accounts may change or be withdrawn at any time by operators; restrictions or bans may occur.

The Platform, content, and tools are general information/automation only and do not constitute financial, investment, legal, tax, or gambling advice. TPC does not consider your objectives or financial situation. You bear all risk, should make your own decisions, and should obtain independent advice as needed. Past performance is not indicative of future results.

• When you connect any Third-Party Betting Program/Operator, you authorise TPC to transmit instructions you configure (e.g., to place/modify/cancel bets; act on bonus eligibility).

• Interactions may occur via APIs, web integrations, or other methods permitted by the operator. Third-party systems may be unavailable, rate-limited, delayed, altered, inaccurate, or blocked.

• You must ensure rules/limits are correct; maintain adequate funds with operators; and ensure your activity is lawful and consistent with operator terms.

• You acknowledge actions may be missed, delayed, duplicated, or rejected due to factors outside TPC’s control.

• Fees are as displayed at purchase and payable in advance for the subscription term.

• Subscriptions auto-renew unless cancelled before renewal; you authorise recurring charges.

• Except as required by law, fees are non-refundable, including for partial periods, unused features, or account suspension/termination due to breach.

• We may change fees on notice for future terms.

• Fees are exclusive of taxes; you are responsible for all applicable taxes.

Prohibited conduct: You must not violate laws or operator terms; attempt to circumvent security, limits, or eligibility rules; reverse engineer; disrupt the Platform; upload/transmit malware; attempt unauthorised access; or use the Platform for unlawful, abusive, fraudulent, or high-risk activity.

Zero-tolerance conduct includes:

(a) Confidentiality of internal content: Proprietary content, models, rules, analytics, settings, and member-only communications are confidential. Sharing/distributing/leaking without written consent is prohibited and may result in immediate termination, lifetime ban, forfeiture of fees, and legal action.

(b) Promotion of external services: Promoting or linking to competing tipsters, affiliates, or third-party gambling providers in TPC spaces is prohibited.

(c) Spam/abuse/misconduct: No harassment, discriminatory language, manipulation, or disruptive conduct.

(d) Reckless gambling behaviour: We support responsible gambling. Encouraging unsafe conduct may lead to removal or restriction.

• The Platform and all TPC content are owned or licensed by TPC and protected by law.

• TPC grants you a personal, limited, revocable, non-exclusive, non-transferable licence to access and use the Platform solely as permitted by these Terms.

• You grant TPC a royalty-free, perpetual licence to use feedback/improvements you submit.

• TPC does not control third-party services and is not responsible for their availability, accuracy, rules, limits, promotions, or actions.

• Your relationship with any Third-Party Betting Program/Operator is solely between you and that third party.

• You agree TPC is not liable for, and you indemnify TPC from, any claims, penalties, reversals, account closures, chargebacks, limitations, investigations, or policy actions brought by any Third-Party Betting Program/Operator arising from your use of the Platform, your configurations, or your activity.

• TPC processes personal data in accordance with our Privacy Policy (incorporated by reference) available on our website.

• You are responsible for backing up configurations, logs, and settings. To the maximum extent permitted by law, TPC is not liable for loss, corruption, or destruction of data.

• We implement reasonable safeguards but do not guarantee security or that the Platform will be free of vulnerabilities, malware, or unauthorised access. You assume all cyber risks associated with your use.

• Provide credentials/tokens only via secure workflows and revoke them when no longer required.

To the maximum extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind (express, implied, statutory, or otherwise), including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, or availability. TPC does not warrant that the Services will meet your requirements or be error-free, uninterrupted, secure, free of vulnerabilities, or that outcomes will be profitable or successful. You must not rely on any representation not expressly set out in these Terms.

You acknowledge that betting and the use of automation for wagering are inherently risky and may result in financial loss, including total loss of stakes and exposure to operator sanctions (including restrictions or bans). You use the Platform entirely at your own risk.

To the maximum extent permitted by law:

(a) TPC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, opportunity, goodwill, anticipated savings, data, or use.

(b) TPC’s aggregate liability for all claims is limited to the greater of: (i) AUD $100; or (ii) the fees you paid to TPC in the 3 months preceding the event giving rise to liability.

(c) TPC disclaims liability for operator actions, system/API failures, rate-limits, downtime, internet/telecom failures, malware/ransomware, DDoS/attacks, or any data loss/corruption.

(d) Nothing herein excludes liability that cannot be excluded under applicable law (see Section 18).

You indemnify and hold harmless TPC and its officers, employees, and contractors from and against any and all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Services; (b) your breach of these Terms or of any law; (c) your violation of operator terms or third-party rights; (d) claims by Third-Party Betting Programs/Operators or other third parties arising from your activity or configurations.

TPC promotes responsible gambling practices. Only gamble what you can afford to lose, set limits, and use self-exclusion tools where needed. If gambling is causing harm, seek help from Gambling Help Online or call 1800 858 858 (24/7, free, confidential). TPC may suspend or limit functionality where we reasonably believe harm or non-compliance may occur.

We may suspend or terminate access immediately where we reasonably suspect breach, risk, unlawful use, non-payment, or to comply with law/operator requirements. On termination, your licence ends, access ceases, and we may delete data per our retention policies. Fees are non-refundable except as required by law. Provisions intended to survive (including IP, fees, disclaimers, limitations, indemnities) survive termination.

We may modify the Services or these Terms at any time. We will post updated Terms with a revised “Last Updated” date (and, for material changes, provide reasonable additional notice). Continued access or use after the effective date constitutes acceptance.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies that cannot be excluded under applicable law (e.g., the Australian Consumer Law). Where permitted, our liability for breach of a non-excludable guarantee is limited (at our option) to re-supplying the Services or paying the cost of re-supply.

Any beta, preview, or experimental features are provided AS IS, may be unstable, and may be withdrawn at any time. All disclaimers and limitations herein apply.

TPC is not liable for delay or failure to perform due to events beyond reasonable control, including failures of third-party services/networks, operator policy changes, government actions, or cyber incidents.

You may not assign or transfer your rights or obligations without TPC’s prior written consent. TPC may assign these Terms without restriction.

You consent to receive notices electronically via the Platform, email, or your account dashboard. Notices are deemed given when sent or posted.

These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria, Australia.

These Terms (and incorporated policies) are the entire agreement between you and TPC and supersede all prior or contemporaneous representations or agreements. If any provision is held invalid, the remainder remains in effect. No waiver of any term is a waiver of any other term.
